Rules and Regulations


NO PURCHASE OR PAYMENT OF ANY KIND BY ENTRANTS IS NECESSARY TO ENTER OR WIN THIS COMPETITION. MANY WILL ENTER; ONE WILL WIN. ENTRIES ARE OPEN ONLY TO MUSICAL ACTS AGE 13 AND OVER. VOID IN TERRITORIES AND POSSESSIONS WHERE PROHIBITED BY LAW.


1. Sponsor


The 2019 Opening Act Competition (“Competition”) is presented by Radio.com and facilitated by Crow Vote LLC (“Sponsor”) crowd voting software.


2. Eligibility


This competition is open to ALL musicians - including but not limited to vocalists, instrumentalists, bands, DJs, songwriters, etc. Entrants must be 13 years of age or older, void where prohibited by law. Employees and agents of the Sponsor, the Competition and its partners, affiliates and/or subsidiaries (collectively, the “Competition Entities”) are ineligible to participate.

All entries must be received by Sept 4th, 2019 to be eligible for inclusion in the Competition. The Competition Judging Panel (“Judging Panel”) will do a preliminary screening of all entries and uploaded material, including but not limited to images, audio and video files, links to other online services, etc., (collectively “Digital Materials”), for compliance with the rules and adherence to the judging criteria as well as hand- selecting entrants that will be eligible to enter the Competition’s public voting phase.

Any submitted Digital Materials must not contain or convey any content that the Judging Panel determines, at its sole discretion, subjectively or otherwise, (i) to be indecent, profane, obscene, explicitly sexual, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, libelous, or hateful, (ii) to be racially, ethnically, or otherwise offensive or objectionable, (iii) to encourage unlawful behavior, (iv) to infringe upon the brand names, trade-marks, trade names, logos, or any other intellectual property that may belong to a third party, or (v) to disclose any detailed personal, physical, contact data, or otherwise confidential information that may belong to a third party (collectively, the “Judging Criteria”).

At the end of each round of the Competition, those whose entries were selected to continue in the Competition shall be notified of such via email. Limit one (1) entry per person for the entire Competition Period. Entries, including but not limited to photographs, music files and all Digital Materials are for Sponsor use and will not be returned, therefore do not post originals. Sponsor is not responsible for lost, late, incomplete, or misdirected entries.


3. How to enter


No purchase, entry fee, payment, or proof of purchase necessary to participate. An entry will not be accepted unless the Participant provides a Date of Birth (DOB) acknowledging that he/she is 13 years of age or older, and accepts and agrees to be bound by all Competition rules. A Parental Consent Form will be emailed to each entrant under the age of 18 (and 13 or older). A completed and returned Parental Consent Form, if applicable, is required to participate in the Competition.

In addition to completing the official entry form, each Participant must submit one photo and one music sample (Digital Materials), per the content guidelines in section “2. Eligibility.” The music submitted must not infringe on any third-party rights and must be suitable for publication and public consumption. Submitted Digital Materials that do not conform to the specifications described above will not be accepted, and the entries to which such Digital Materials relate will not be eligible for inclusion in the Competition. Submission of a qualifying entry grants Sponsor and its agents the right to use the Digital Materials to (i) promote the Competition, (ii) promote the “We Can Survive” 2019 music event, and (iii) promote other Sponsor and Radio.com-related activities.


4. Competition period


The Judging Panel will do a preliminary screen of all entries for compliance with the Rules herein and adherence to the judging criteria, as well as hand-selecting participants in advance of the initial public voting round, and divide entries into equal-sized groups.

PUBLIC VOTING BEGINS AUGUST 27TH, 2019

Top 5 Cutoff (Starts Aug 27th and Ends Sept 5th) - Selected Entrants will be divided equally into groups. Public voting will help reduce each group to the top five competitors.

Group Winners (Starts Sept 5th and Ends Sept 12th) - Public voting will help reduce the top five (5) competitors to one (1) preliminary winner in each group.

Semi-Finals (Voting Resets)

Semi-finals (Starts Sept 13th and Ends Sept 19th) – Preliminary group winners will be divided evenly into semi-final groups. Public voting will determine one (1) winner from each semi-finals group that will advance into the finals.

Finals (Battle Rounds)

Public voting will help reduce the sixteen (16) finalists to the one (1) winner of the competition (the “Grand Prize Winner”) by process of competitor-vs-competitor single elimination. Voting resets for each battle round and winner is subject to compliance with the Rules and any other applicable terms and conditions in connection with the Competition.


5. Public voting


During the Competition, anyone voting with a valid "Real" Facebook account (“Voter” or “Voters”) may cast one or more votes for one or more competitors. 1) Voters can vote once for free every 24-hours (once a day) via Facebook , and 2) Voters can purchase additional votes (for one or more competitors). Qualifying votes shall only be cast in accordance with the instructions as listed in the competition Terms and Conditions. The winning Participant(s) of each round of the Competition will be determined based upon the number of qualifying votes received, with those receiving the highest number of qualifying votes deemed the winner(s). NOTE: IT IS NOT NECESSARY FOR ANY PARTICIPANT TO PAY AN ENTRY FEE, CAST A VOTE, OR TENDER A PAYMENT OF ANY KIND IN ORDER TO ENTER OR WIN THIS COMPETITION. “Bot” activity or any kind of robotic or automated voting mechanism are not acceptable forms of voting. If this type of false voting is detected by our server, the associated IP address will be banned from voting. Crow Vote LLC reserves the right to disqualify participants suspected in partaking in this type of activity, or any other voting activity deemed unfair.


6. Conduct


By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of Arizona without giving effect to any choice of law or conflict of law rules, and Entrants consent to the jurisdiction and venue of the federal, state, and local courts located in Maricopa County, Arizona. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right, in its sole discretion, to disqualify any individual: (a) acting in any manner deemed by Sponsor to be in violation of these Official Rules; or (b) acting in any manner deemed by Sponsor to be unsportsmanlike, disruptive, and/or with intent to annoy, abuse, threaten, or harass any other person.

COMPETITORS ARE NOT PERMITTED TO CAST PAID VOTES FOR THEMSELVES, PARTICIPANTS/MUSICIANS CAUGHT UTILIZING THEIR PERSONAL PAYMENT METHODS AND CASTING PAID VOTES FOR THEMSELVES MAY BE SUBJECT TO VOTE LOSS OR DISQUALIFICATION.

“Bot” activity or ANY automated or mechanical methods are NOT acceptable forms of voting. If this type of false voting is detected by our software, the associated IP address will be banned from voting. Crow Vote LLC reserves the right to disqualify competitors suspected in partaking in this type of voting activity, or any other voting activity deemed unfair. ANY ATTEMPT BY A VOTER OR COMPETITOR OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.


7. Winner


Winner will be selected by public voting and is not subject to random chance. One (1) Grand Prize winning Entrant will be selected to perform as the opening act at the “We Can Survive” music event at the Hollywood Bowl, Los Angeles, CA., on October 19th, 2019. If the winning Entrant is not available, an alternate winner will be selected, time permitting. The winning Entrant will receive a cash honorarium of $10,000 and such other prizes as Sponsor so selects in its sole and absolute discretion. Cash winnings will be provided after receiving all necessary documentation (See Section 8) in compliance with competition eligibility, successful completion of the music performance at the “We Can Survive” event and other Winner-related activities as required by Sponsor. By agreeing to appear as the Grand Prize winning Entrant, the winning Entrant consents to the use of their name, music sample, photos, videos and/or likenesses for advertising and trade purposes in connection with The Opening Act Competition, in any and all media known or hereinafter invented without territorial or time limitations and without additional compensation, except where prohibited. No Grand Prize substitutions or cash redemption allowed. Sponsor reserves the right, in its sole discretion, to not use the submitted music sample, photography or video. By accepting the prize money, the winner acknowledges compliance with these Official Rules. To the extent that any federal and/or state income or other taxes apply to the value of the prize(s) and/or award(s) provided to the winning Entrant, the winning Entrant shall be solely responsible for the reporting and payment of such taxes.


8. Prizes


One (1) verified first (1st) place Grand Prize winner will receive a prize package valued at an approximate maximum retail value of $16,000.00, comprised of the following:

All prize values above are approximate and the final value will depend upon the location from which any winner will be traveling and the date on which travel is booked.

All individual(s) traveling as part of any prize described herein must all travel on the same itinerary.

Winner(s) and their guest(s) are solely responsible for obtaining any travel documents that may be required, including but not limited to passports.

Reservations are non-transferable and once booked and confirmed may not be rescheduled. Except with respect to ground transportation per applicable prize winner descriptions herein, winners and their guests will be solely responsible for all ground transportation, for the purchase of any items of a purely personal nature, for the payment of any incidental expenses, and for the payment of any taxes, charges, and/or fees.

Winners may be required to provide a valid credit card to check into the hotel and to cover incidental expenses.

Winners will be solely responsible for the pre-payment of any applicable taxes or airport, baggage, or government fees or charges.

Any prize(s) involving travel, including without limitation prizes consisting in whole or in part of overnight accommodations and/or travel by air will be based upon availability and subject to additional terms and restrictions imposed by KAMP, other sponsors, and/or other agents participating in the competition and/or fulfillment of the prize, including without limitation blackout dates, peak period restrictions, expiration dates, and/or additional age restrictions imposed upon the winner and/or the winner’s guest(s).  These restrictions are not subject to negotiation.  Winner’s guests may be required to sign one or more liability release agreements before being authorized by KAMP or its sponsor to be allowed to participate as winner’s guest on a trip.  In addition, such winners and guest(s) are required to travel on the same itinerary, to which changes may not be made once booked, and are solely responsible for obtaining any international travel documents, visas or passports that may be required.  Reservations are non-transferable and once booked and confirmed may not be rescheduled.  Winners may be required to provide a valid credit card to check into the hotel and to cover incidental expenses.

Any prize(s) that consists of an opportunity to meet with, participate in an activity with, interview or have similar interaction with any celebrity (other than employees of KAMP) is contingent upon the celebrity appearing for such activity/event, which is beyond KAMP’s control.  KAMP is not responsible if a winner and/or his/her guests are unable to meet such celebrity or participate in the associated activity if the celebrity determines this is not allowable for any reason or fails to appear/participate for any reason, including without limitation any illness, act of god, scheduling conflict or any other reason, KAMP is not responsible for such portion of the prize, which has no monetary value, and no alternate prize will be awarded and the event/activity will not be rescheduled. In the event that KAMP elects, at its sole discretion, to attempt to reschedule any such event/activity or offer an alternative prize, KAMP will have no obligation whatsoever to offer any other alternate prize if such attempt to reschedule or other offer is not accepted by or utilized by winner for any reason whatsoever.


9. Verification of winner


Potential winners will be required to execute an affidavit of eligibility, a liability/publicity release, and other documents (“Prize Claim Documents”), as may be required or permitted by law. If any potential winner fails or refuses to sign and return all Prize Claim Documents within fourteen (14) days of prize notifications sent, the winner may be disqualified, and an alternate winner may be determined/selected. Sponsor is not responsible for any change in address of Entrants.


10. General


The Competition is governed by the laws of the State of Arizona, with venue in Maricopa County, Arizona, and all claims must be resolved in the local, state, or federal courts of Maricopa County, Arizona. By entering this Competition, participants agree to abide by and be bound by these Official Competition Rules and the decisions of the judges, which are final in all matters related to the Competition. Competition Entities also reserve the right, at their sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition. This Competition is subject to all applicable federal, state, and local laws. By participating in the Competition, participants agree to be bound by these Official Rules and the decisions of the judging organization and waive any right to claim ambiguity in the Competition or these Official Rules. Winner and participants also agree to release, discharge, indemnify, and hold harmless the Competition Entities, and the officers, employees, contractors, and agents of each, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, use, loss, or misdirection of any prize, or participation in any Competition- related activity or participation in this Competition, or any other error in the offering or announcement of any prize and hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; all causes of action arising out of or connected with this promotion, or any prize awarded shall be resolved individually, without resort to any form of class action; and any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Sponsor is not responsible for lost, late, incomplete, or misdirected entries. If you are selected as the winner, your information may also be included in a publicly available winner’s list.
